REGULATION
about the Institute of Postgraduate Education of the Academy of Law Enforcement Agencies under the General Prosecutor’s Office of the Republic of Kazakhstan

1. General Provisions

1. The Institute of Postgraduate Education of the Academy of Law Enforcement Agencies under the General Prosecutor’s Office of the Republic of Kazakhstan (hereinafter referred to as the Institute, Academy, General Prosecutor’s Office) is an independent structural unit of the Academy.

2. The Institute in its activities is guided by the Constitution of the Republic of Kazakhstan, the Constitutional Law of the Republic of Kazakhstan “On the Prosecutor’s Office”, the laws of the Republic of Kazakhstan “On Law Enforcement Service”, “On Education”, “On Science”, other legal acts of the Republic of Kazakhstan relating to the activities of the Institute, organizationally – administrative acts of the Prosecutor General of the Republic of Kazakhstan (hereinafter referred to as the Prosecutor General), his deputies, the rector of the Academy, as well as these Regulations.

3. The structure and staffing of the Institute is approved by the Prosecutor General of the Republic of Kazakhstan upon the proposal of the Rector of the Academy in the manner established by the legislation of the Republic of Kazakhstan.

4. The Institute consists of:

Department of educational and methodological work;

Departments of Social and Humanitarian Disciplines;

Departments of General Legal Disciplines;

Departments of special legal disciplines.

2. Objectives, rights and responsibilities of the Institute

5. Objectives of the Institute:

— ensuring the implementation of educational programs of postgraduate education;

— organization of work with undergraduates and doctoral students of the Academy;

— implementation, organization of promotion of paid types of services within the competence of the Institute.

6. Rights and obligations of Institute employees.

In accordance with the legislation and organizational and administrative acts of the Prosecutor General and the Rector of the Academy, employees of the Institute:

has the right:

participate in meetings with the leadership of the Prosecutor General’s Office, the rector of the Academy, heads of structural divisions of the Academy, as well as those organized and held in government bodies and non-governmental organizations on issues related to the activities of the Institute;

request and receive, in the prescribed manner, information and materials from the structural divisions of the Academy necessary to fulfill the tasks and functions assigned to the Institute;

request and receive, in accordance with the procedure established by law, information and materials from government bodies, organizations and institutions on issues related to the activities of the Institute;

interact with government bodies, institutions and organizations on issues within the competence of the Institute;

make proposals for improving legislation, organizing the work of the Academy, Institute, and other bodies and institutions of the prosecutor’s office;

for professional retraining, advanced training and internship of employees in the manner prescribed by law;

participate in scientific, practical and other educational events, including international conferences, seminars and round tables;

exercise powers to organize paid services provided for by law, legal acts of the Prosecutor General, Rector of the Academy;

exercise other powers provided for by law, legal acts of the Prosecutor General, Rector of the Academy;

are obliged:

perform the tasks and functions assigned to the Institute in a quality and timely manner in accordance with current legislation and these Regulations;

carry out activities within the limits of the granted powers;

strictly comply with the requirements of the law, acts of the Prosecutor General and the Rector of the Academy when performing the tasks and functions assigned to the Institute;

within the limits of competence, take measures to eliminate and prevent further identified violations of the law;

get acquainted with the legal acts of the Prosecutor General, the rector of the Academy, regulating the activities of the Academy and its structural divisions, and other legal acts relating to the tasks and functions of the Institute;

develop projects and update legal acts and organizational and administrative documents in accordance with the objectives and functions of the Institute;

in the manner and within the time limits established by law, consider requests from individuals and legal entities;

participate in working groups, interdepartmental meetings when considering projects and conducting legal monitoring of legal acts on assigned issues;

keep state secrets and other secrets protected by law;

exercise other powers provided for by regulatory legal acts, legal acts of the Prosecutor General and the Rector of the Academy.

7. Functions of the Institute:

1) organization and conduct of the educational process, including distance learning in the manner established by law, legal acts of the Prosecutor General and the Rector of the Academy;

2) organization and conduct of educational and methodological work on educational programs of postgraduate education, research work in one or more similar disciplines of the departments of the Institute in the manner established by law, legal acts of the Prosecutor General and the Rector of the Academy;

3) organization and conduct of ongoing monitoring of academic performance, intermediate and final certification of students in the manner established by law, legal acts of the Prosecutor General and the Rector of the Academy;

4) organization of professional practice and internship for Academy students in the manner established by law, legal acts of the Prosecutor General and the Rector of the Academy;

5) support of the activities of the extended meeting of the graduating department of the Academy;

6) interaction with educational institutions within the framework of agreements and memorandums concluded by the Academy;

7) carrying out an analysis of the educational activities of the Institute for compliance with regulatory legal acts (hereinafter referred to as RLA);

8) searching, studying, making proposals and introducing into the practical activities of the Institute positive foreign and national experience, innovative forms and methods of implementing educational programs of postgraduate education;

9) development, approval and updating of legal acts relating to the organization of the Institute’s activities, including on issues of improving the educational process;

10) participation in working groups, interdepartmental meetings, consideration of projects and legal monitoring of legal acts, making proposals for improving legislation;

11) organizing events and taking measures to improve the qualifications of the Institute’s teaching staff;

12) admission of students to the Academy for educational programs of postgraduate education, including ensuring propaganda work;

13) maintaining a register of scientific publications of the Institute;

14) making proposals to improve the activities of the Institute;

15) development of legal acts on the organization of work with students;

16) organization of work on enrollment, transfer, reinstatement and expulsion of master’s and doctoral students of the Academy;

17) organization of educational work among students in the manner established by legislation, legal acts of the Prosecutor General and the Rector of the Academy;

18) ensuring organization and control over students’ compliance with the requirements established by the Internal Regulations of Academy students;

19) organization of work on other social issues of students within the competence of the Institute;

20) support of the activities of the Academy’s Council of Master’s and Doctoral Students;

21) making proposals to improve the organization of work with undergraduates and doctoral students of the Academy;

22) provision of paid types of services, search for potential customers for services, goods and works;

23) interaction with structural divisions of the Academy on the provision of paid services;

24) making proposals to improve the provision of paid services;

25) implementation of other functions provided for by regulatory legal acts, legal acts of the Prosecutor General and the Rector of the Academy.

3. Organization of the Institute’s activities

8. The Institute has the powers necessary to implement its main tasks and functions, in accordance with legislative acts, acts of the President, other regulatory legal acts, orders, instructions, instructions of the Prosecutor General and the Rector of the Academy.

9. The Institute is headed by a director, appointed and dismissed by the Rector of the Academy in the manner prescribed by law.

10. The Director of the Institute has a Deputy Director-Head of the Department of Educational and Methodological Work, who replaces the Director of the Institute during his absence.

11. The Director of the Institute carries out general management of the activities of the Institute and bears personal responsibility for the implementation of the tasks assigned to the Institute and the implementation of its functions. During the absence of the Director of the Institute, his duties are performed by a person determined in accordance with the distribution of responsibilities among the leading officials of the Academy approved by order of the Rector of the Academy.

12. For these purposes, the director of the Institute:

1) submits to the rector of the Academy, agreed with the supervising vice-rector of the Academy, proposals on the structure and staffing of the Institute;

2) in agreement with the supervising vice-rector of the Academy, determines the powers of the heads of structural divisions of the Institute;

3) organizes and coordinates the work of the Institute, ensures interaction of the Institute with the General Prosecutor’s Office, its departments and institutions, structural divisions of the Academy, regional prosecutor’s offices and equivalent central government bodies;

4) holds operational meetings on the work of the Institute, distributes received materials and appeals among the Institute’s employees, gives them instructions in accordance with their functional responsibilities;

5) organizes the preparation of materials for certification of employees of the Institute;

6) in agreement with the supervising vice-rector of the Academy, carries out the selection and placement of personnel at the Institute, provides subordinate workers and employees with proper working conditions;

7) in agreement with the supervising vice-rector of the Academy, makes proposals to the rector on encouraging or applying disciplinary measures, assigning a class rank, class qualifications in relation to employees and employees of the Institute;

8) ensures compliance by workers and employees of the Institute with performing, service and labor disciplines;

9) organizes and ensures control over the execution of orders, instructions, orders, instructions of the Prosecutor General, the rector of the Academy, the supervising vice rector of the Academy, decisions of collegial bodies of the Prosecutor General’s Office, the Academy, staff and operational meetings under the Prosecutor General and the rector on issues within the competence of the Institute;

10) conducts personal reception of Academy students;

11) performs other duties and personal assignments on behalf of the rector supervising the vice-rector of the Academy;

12) signs official documentation on behalf of the Institute.

13) exercises other powers in accordance with laws, acts of the President, orders of the Prosecutor General and the Rector of the Academy.

13. Deputy Director-Head of the Department of Educational and Methodological Work of the Institute:

1) coordinates the activities of the Institute and its structural divisions within the limits of its powers;

2) makes proposals to the director of the Institute on the selection of personnel, distribution of responsibilities, assignment of class rank, class qualifications, encouragement, and bringing to disciplinary liability in relation to employees of the Department of Educational and Methodological Work of the Institute;

3) ensures the preparation of materials for certification of employees of the Institute;

4) exercises direction and control over the activities of the headed unit, compliance by employees with performance, service and labor disciplines;

5) conducts reception of Academy students;

6) holds operational meetings on issues of supervised areas, distributes received materials and appeals among the Institute’s employees, gives them instructions in accordance with their functional responsibilities;

7) organizes the work of the headed unit and plans its work, bears personal responsibility for the proper performance of official (functional) duties by employees of the entrusted unit;

8) determines the rights and obligations of employees and employees of the headed unit;

9) ensures advanced training of subordinate employees and workers;

10) participates in the work of collegial bodies of the Academy;

11) organizes the paperwork of the Institute;

12) signs official documentation within the scope of competence addressed to the director of the Institute;

13) organizes the explanatory and image work of the Institute;

14) organizes cultural, sports and other events of the Institute;

15) performs other functions assigned to him by the supervising vice-rector of the Academy and the director of the Institute.

14. Employees and workers of the Institute perform their assigned functional responsibilities in accordance with the substantive principle of distribution of responsibilities, as well as other instructions of the Institute’s management.

15. Documents sent to the leadership of the Academy on issues within the competence of the Institute are signed by the supervising vice-rector, and in case of absence – by his deputy.

Documents sent on behalf of the Institute to other structural divisions of the Academy on issues within the competence of the Institute are signed by the director of the Institute, and in the absence of the director of the Institute – by his substitute.

16. The Institute reports directly to the rector of the Academy, the supervising vice-rector, organizationally and functionally independent of other structural divisions and officials of the Academy.

17. General office work at the Institute is carried out in accordance with the Rules for documenting and managing documentation in bodies, departments, institutions and educational organizations of the prosecutor’s office and organizational and administrative acts to ensure secrecy.
