REGULATION
on the Scientific and Methodological Council of the Law Enforcement Academy under the Prosecutor General’s Office of the Republic of Kazakhstan

1. General regulations

1. The Scientific and Methodological Council (hereinafter – the SMC) is an interdepartmental consultative and advisory body created to form a unified scientific policy of the law enforcement agencies of the Republic of Kazakhstan.

2. The SMC is guided by the Constitution, Laws of the Republic of Kazakhstan “On Law Enforcement Service”, “On the Prosecutor’s Office”, “On Education”, “On Science” and other normative legal acts of the Republic of Kazakhstan, the Charter of the Law Enforcement Academy under the Prosecutor General’s office of the Republic of Kazakhstan (hereinafter – the Academy) and this Regulation.

3. The SMC operates on the basis of the Academy. It consists of the Rector, Vice-Rectors of the Academy, heads of administrations and personnel services of law enforcement agencies, representatives of government bodies and the scientific community. The composition of the SMC is approved by order of the Prosecutor General of the Republic of Kazakhstan in coordination with the first heads of law enforcement agencies.

2. Main tasks of the SMC

4. The main tasks of the SMC are:

1) coordination of the quality of scientific activities of law enforcement agencies, and also activity on the participation of scientific departments of law enforcement agencies in competitions held by the authorized body in the field of education and science, state bodies, and international organizations in the order established by the legislation;

2) improvement of law enforcement practice;

3) identification of topical research topics for scientific departments of law enforcement, postgraduates and doctoral students of the Academy;

4) consideration of draft annual and future plans of research work;

5) formulation of research tasks for scientific departments of law enforcement agencies, postgraduates and doctoral students of the Academy;

6) analysis and evaluation of the effectiveness of the implementation of research results in practical, rule-making activities and the educational process.

3. Functions of the SMC

5. To perform tasks the SMC:

1) defines topical research topics in the field of law enforcement, including postgraduates and doctoral students of the Academy, plans and work programs of scientific research;

2) considers and approves interdepartmental scientific concepts, proposals for the programs of scientific development of law enforcement agencies;

3) discusses and develops recommendations on the main areas of research work in order to implement priority areas of law enforcement;

4) considers and develops recommendations on the approval and implementation of research plans of the Academy, the implementation of research results in practical, standard-setting activities and the educational process of law enforcement agencies;

5) makes recommendations on the improvement of scientific research, as well as on the effective use of funds for research works;

6) creates author’s collectives to carry out scientific researches from among representatives of law enforcement agencies, the organizations of education of law enforcement agencies, other scientific organizations, educational institutions, and also the scientific community;

7) ensures the dissemination and use of research in operational activities of law enforcement agencies, as well as analyzes the effectiveness of the implementation of scientific research;

8) promotes the dissemination of advanced scientific and methodological experience in law enforcement education organizations;

9) promotes mutually beneficial exchange of scientific, methodical literature and information materials between educational organizations of law enforcement agencies;

10) makes recommendations on sending the scientific staff of the Academy on business trips to study the practical use of the results of scientific research, their relevance, in coordination with the heads of law enforcement agencies, law enforcement education organizations;

11) promotes scientific research in cooperation with other scientific organizations and higher education institutions, including international;

12) hears reports of heads of research topics and individual researchers on the results of scientific activities.

4. The procedure for the election and operation of the SMC

6. The Chairman of the SMC is the Rector of the Academy. In case of absence of the Chairman, his functions are performed by the person replacing him.

7. Meetings of the SMC are convened by its Chairman or the person acting as necessary, but at least once a half-year.

8. The decisions of the SMC are advisory in nature.

9. The Chairman of the SMC:

1) provides general guidance;

2) plans the work of the SMC and defines activities aimed at improving the quality and efficiency of decisions;

3) approves the agenda of the meetings, final documents and recommendations on the issues under consideration;

4) monitors the implementation of decisions of the SMC;

5) in agreement with the members of the SMC for research of mutual interest, approves the composition of the authors’ collectives;

6) approves an interagency program of research of work of law enforcement agencies;

7) approves reports on the results of interdepartmental research;

8) appoints experts to consider applications for scientific research received for approval by the SMC, as well as other materials on ongoing and completed research.
10. The working body of the SMC is the Secretariat.

11. The Secretary of the SMC is the Director of the Interdepartmental research Institute of the Academy.

12. Members of the Secretariat and sections of the SMC are formed from among the staff of the Academy, representatives of law enforcement agencies, departmental educational institutions appointed by the order of the Rector of the Academy.

13. The Secretariat ensures the proper functioning of the SMC, in particular:

1) forms the work plan of the SMC;

2) informs the members of the SMC about the date, time and place of the meeting;

3) organizes and controls the preparation of materials submitted for consideration of the meeting;

4) draws up the protocol of the meeting;

5) organizes and controls the implementation of decisions of the SMC;

6) performs other orders necessary to ensure the effectiveness of the SMC;

7) sends requests to law enforcement agencies, other scientific organizations, educational institutions, representatives of the scientific community.

14. The SMC sections are created in priority areas of scientific activity of law enforcement agencies. The sections interact with members of the SMC through the Secretariat.

15. To carry out the functions, the sections:

1) make proposals on current research topics, including postgraduates and doctoral students of the Academy, plans and work programs of scientific research;

2) develop interdepartmental scientific concepts, make proposals to the programs of scientific development of law enforcement agencies;

3) develop proposals for the main areas of research;

4) define research tasks for scientific departments of law enforcement agencies, postgraduates and doctoral students of the Academy;
5) carry out preparation of the research projects;

6) analyze the effectiveness of the implementation of research results;

7) carry out interaction between law enforcement agencies, as well as with other scientific organizations and higher educational institutions, including international;

8) ensure the coordination of the work of the interdepartmental teams of law enforcement agencies;

9) provide monitoring of quality of scientific activity of law enforcement agencies;

10) submit to the Chairman for approval reports on the results of interdepartmental research;

11) develop proposals for the improvement of scientific research, as well as for the effective use of financial resources for research and submit them to the SMC;

12) carry out other instructions of the Chairman of the SMC necessary to ensure the effectiveness of the SMC.

16. Meetings of sections can be held in remote mode.

17. The SMC member has the right to:

1) make proposals, comments and amendments on the substance of the discussed issues and on the agenda;

2) participate in the preparation of materials for the meetings of the SMC, as well as its draft decisions, to participate in the implementation of decisions of the SMC;

3) get acquainted with the protocols and materials of the SMC meetings;

4) submit proposals, comments, draft documents and decisions for their further discussion and possible adoption by the members of the SMC;

5) in case of disagreement with the decision of the SMC to express own opinion in written form, which is recorded in the protocols of the SMC meeting and is attached to the decision in respect of which this opinion is expressed;

6) enjoy the rights granted to members of the SMC.

18. Member of the SMC has to:

1) be present at the meetings of the Council, to take an active part in its work, to carry out the tasks assigned to it in a timely and qualitative manner;

2) promote the functions and objectives of the SMC;

3) inform The Chairman of the SMC if it is impossible to be present at the SMC meeting prior to the meeting for a valid reason, as well as to send within 5 working days his proposals on the issues under consideration in writing form.

19. The SMC meetings are held in the presence of at least 2/3 of the members. The decision of the SMC is taken by an open vote by a simple majority of the members of the SMC present at the meeting. In case of equality of votes of members of the SMC, the vote of Chairman is decisive.

20. The meetings of the SMC and its decisions are recorded in the protocols signed by the Chairman.

21. The members of the SMC are notified by the Secretariat about the date and agenda of the meeting and the issues under consideration no later than 7 working days prior to the meeting. Materials on the issues included in the agenda of the meeting of the SMC and the draft Protocol should be sent to its members not later than 5 working days before their consideration at the meeting.

22. The SMC annually, no later than January 15, sends an annual report to law enforcement agencies on the work done.
