CHARTER
of the State institution “Law Enforcement Academy under the Prosecutor General’s Office of the Republic of Kazakhstan”

1. General Provisions

1. The State institution «Law Enforcement Academy under the Prosecutor General’s Office of the Republic of Kazakhstan» (hereinafter – Academy) is a non-profit organization, possessing the status of a legal entity, established in the organizational and legal form of a public institution.

2. The Academy was established by the Decree of the President of the Republic of Kazakhstan of May 4, 2015 No. 15.

3. The Academy is an organization of education that has a special status that is a part of the system of the Prosecutor’s Office of the Republic of Kazakhstan.

4. The Academy in its activities is guided by the Constitution of the Republic of Kazakhstan, laws, acts of the President of the Republic of Kazakhstan and other regulatory legal acts, as well as this Charter.

5. The structure and staffing of the Academy are approved by the Prosecutor General of the Republic of Kazakhstan (hereinafter – the Prosecutor General).

6. The Prosecutor General’s Office of the Republic of Kazakhstan (hereinafter – the Prosecutor General’s Office) is the authorized body exercising general management and functions of the subject of state property right in relation to the Academy.

7. Full and short name, abbreviation of the Academy:

in the state language – “Қазақстан Республикасы Бас прокуратурасының жанындағы Құқық қорғау органдары академиясы” мемлекеттік мекемесі; “Құқық қорғау органдары академиясы”; “ҚОА”;

in Russian – государственное учреждение «Академия правоохранительных органов при Генеральной прокуратуре Республики Казахстан»; «Академия правоохранительных органов»; «АПО»;

8. Location of the Academy:

The Republic of Kazakhstan, 021804, Akmola region, Tselinograd district, village of Kosshy, Republic street, 16.

2. The legal status of the Academy

9. The Academy has its own balance sheet, stamps with its name, letterheads, symbols, as well as accounts in the treasury and banks in accordance with the legislation of the Republic of Kazakhstan, including in foreign currency.

10. The Academy is responsible for its obligations to the money at its disposal. With its insufficiency, the responsibility of its obligations is borne by the Prosecutor General’s Office.

11. The Academy enters into civil-law relations on its own behalf in the manner prescribed by the legislation of the Republic of Kazakhstan.

12. Civil-law transactions concluded by the Academy, within the limits of approved individual financing plans for obligations and payments, are subject to registration in accordance with the procedure established by the legislation of the Republic of Kazakhstan. Under contractual obligations, the Academy’s responsibility comes within approved individual financing plans for obligations and payments for the maintenance of the Academy in accordance with the legislation of the Republic of Kazakhstan.

13. The Academy has the right to establish branches and representative offices in consultation with the Prosecutor General’s Office.

3. The purpose and objectives of the Academy

14. The purpose of the Academy is to improve the staff of law enforcement agencies and to strengthen the role of legal science in ensuring law, order and the fight against crime.

15. The main objectives of the Academy are:
1) training for first-time applicants for law enforcement service;

2) professional retraining and advanced training of law enforcement officers, including those who are in the Presidential Reserve of the law enforcement authorities of the Republic of Kazakhstan;

3) implementation of educational programs of postgraduate education, in accordance with the license for educational activities issued by the authorized body in the field of education and science;

4) identification of priority areas, coordination and conducting interdepartmental research in the field of law enforcement, implementation of its results in legislative work, the educational process and practical activities;

5) conducting research on actual issues of prosecutorial supervision, ensuring law, order and the fight against crime, the implementation of its results in legislative work, the educational process and practical activities;

6) scientific and methodical support of the coordinating function of the prosecutor’s office in the field of strengthening the rule of law, order and the fight against crime;

7) participation in the formation and implementation of scientific and educational policy in the field of law enforcement;

8) participation in the development and implementation of concepts, doctrines, strategic and program documents, plans in the field of law enforcement;

9) participation in competitions of scientific, scientific-technical projects and programs financed by the state budget and other sources which are not prohibited by the legislation of the Republic of Kazakhstan;

10) development and participation in development of drafts of normative legal acts;

11) conducting scientific examination of draft normative legal acts;

12) cooperation and interaction with government bodies, scientific, educational, specialized organizations and institutions in the implementation of research, educational and training-methodological activities;

13) development and implementation of international cooperation in the scientific and educational sphere;

14) development of the state language in the Academy;

15) improvement of image policy;

16) provision of paid activities for the sale of goods (works, services) in accordance with the legislation of the Republic of Kazakhstan;

17) publishing and printing;

18) working, implementation, maintenance and development of software products and Internet resources aimed at automating the educational process, research and libraries.

16. The list of objectives and types of activities are not exhaustive and the course of action in each specific case is determined by the Prosecutor General and the Rector of the Academy.

17. The main form of realization of the purpose and objectives of the Academy is the implementation of functions reflected in the provisions of the structural units of the Academy, approved by the Rector of the Academy.

4. Management and organization of the Academy

18. Management of the Academy is carried out in accordance with the legislation of the Republic of Kazakhstan and this Charter on the principles of unity of command and collegiality.
19. Organization and management of the Academy is carried out by the Rector of the Academy who is appointed to the post and dismissed by the President of the Republic of Kazakhstan on the proposal of the Prosecutor General, coordinated with the Commission under the President of the Republic of Kazakhstan on the issues of personnel policy in law enforcement agencies of the Republic of Kazakhstan.

20. For this purpose the Rector of the Academy:

1) acts on the principles of unity of command and collegiality, independently solves the issues of the activities of the Academy in accordance with its competence determined by the legislation of the Republic of Kazakhstan and this Charter;

2) organizes and directs the work of the Academy, reports directly to the Prosecutor General and bears responsibility for the implementation of tasks assigned to the Academy;

3) submits the structure and staff schedule of the Academy with the established staffing level to the Prosecutor General for approval;

4) approves work plans, regulations on structural division of the Academy;

5) makes proposals to the Prosecutor General to improve educational, research, financial and economic activities and to strengthen material and technical support;

6) issues orders, instructions and other organizational and administrative acts mandatory for all employees, administrative civil servants (hereinafter – employees) and workers under the labor contract (hereinafter – workers), trainees and students of the Academy;

7) leads the selection and placement of personnel of the Academy;

8) hires, transfers, relocates and dismisses employees and officers, except for employees appointed and dismissed by the Prosecutor General, concludes, modifies and terminates labour contracts with workers in accordance with the labour legislation of the Republic of Kazakhstan;

9) organizes admission, expulsion, transfer and reinstatement of students in the prescribed manner;
10) acts on behalf of the Academy without a power of attorney, represents its interests in all state bodies and institutions and other organizations;

11) concludes contracts, issues powers of attorney to perform actions related to the activities of the Academy;

12) concludes agreements and contracts with foreign organizations in all main areas of the Academy;

13) organizes the interaction of the Academy with the structural subdivisions of the Prosecutor General’s Office, regional prosecutor’s offices and state bodies, institutions, departments, education organizations and other state and non-state governmental organizations equated to them, including international and foreign ones;

14) organizes the departure of employees and officers of the Academy to the prosecutor’s office for the purpose of analysing their activities, checking on developing the professional level of employees, testing the results of scientific research, providing practical and methodological assistance;

15) applies incentives measures and imposes disciplinary sanctions on employees and officers of the Academy in accordance with the legislation of the Republic of Kazakhstan;

16) organizes work on mobilization training and civil defence, ensuring the safety of the state, official secrets and compliance with the requirements of the regime secrecy;

17) exercises other functions entrusted to him by the legislation of the Republic of Kazakhstan, organizational and administrative acts of the Prosecutor General and this Charter.

21. The first vice-rector of the Academy are appointed and dismissed by the Prosecutor General in agreement with the Commission under the President of the Republic of Kazakhstan on the issues of personnel policy in law enforcement agencies of the Republic of Kazakhstan.

22. The highest collegial governing body of the Academy is the Academic Council which is created by the order of the Rector of the Academy.

The competence, composition and organization of the activities of the Academic Council are determined by the legislation of the Republic of Kazakhstan, organizational and administrative acts of the Prosecutor General, the Rector of the Academy.

22-1. In order to form a unified scientific policy in the field of law enforcement, the Academy has a Scientific Methodological Council (hereinafter referred to as the SMC), created by order of the Prosecutor General.

The tasks, functions, procedure for electing and organizing the activities of the SMC are determined by the Regulations on the SMC approved by order of the Prosecutor General.

26. In order to provide educational and methodological support for the educational process, the Educational-methodological Council created by the order of the Rector of the Academy is functioned in the Academy.

The competence, composition and organization of the activities of the Academic Council are determined by the legislation of the Republic of Kazakhstan, organizational and administrative acts of the Rector of the Academy.

28. Other collegial and consultative-advisory bodies (councils, working groups, commissions, including on the secrecy regime, attestation, housing and household and others) may be established by the order of the Rector of the Academy.

29. Other issues related to the operational management of the Academy, official and executive discipline are considered at operational meetings with the Rector of the Academy.

5. The procedure for admission to the Academy, transfer, expulsion and reinstatement of students

30. The procedure for admission to the Academy is regulated by rules approved by the order of the Prosecutor General.

31. Formation of a contingent of student of the Academy is carried out on a competitive basis, in accordance with the State educational order for the training specialists with postgraduate education and with the Plan for admission for the relevant academic year which is approved by the order of the Prosecutor General.

32. Masters and doctoral studies of the Academy for full-time education, including distance learning technology, are admitted by law enforcement officers of the Republic of Kazakhstan with higher and postgraduate education respectively.

Law enforcement officers of foreign countries may be admitted to the Academy for training in the manner established by the legislation of the Republic of Kazakhstan and international treaties of the Republic of Kazakhstan.

33. Organization of admission is carried out by the Academy’s Admission Commission.

34. The Chairman of the Admission Commission is the Rector of the Academy. The membership of the Admission Commission is approved by the order of the Rector of the Academy. Work and office work of the Commission is organized by the secretary of the Admission Commission appointed by the Rector of the Academy.

36. The decision on admission to the Academy is made by the Admission Commission at an open meeting on a competitive basis taking into account the number of available places. Admission to the Academy is formalized by the order of the Rector of the Academy on the basis of the decision of the Admission Commission.

37. The procedure of transferring, expulsion and reinstatement of students is regulated by the rules approved by the order of the Prosecutor General, normative legal acts of the authorized body in the field of education and science.

38. Disciplines studied in another higher education institution, including foreign ones can be rechecked for students who study under the programs of bilateral and multilateral exchange.

39. A student can be expelled from the Academy:
1) on a voluntary basis;
2) for academic underachievement;
3) for violation of the internal regulations established in the Academy;
4) for failure to fulfil the obligations (duties) under the education contract, the Charter of the Academy;
5) in other cases established by the legislation of the Republic of Kazakhstan.

40. The basis for the expulsion on a voluntary basis, including transfer to another higher education institution is the application of the student.

41. The expulsion of students from the Academy is carried out by the order of the Rector of the Academy on the proposal of the director of the Institute of the Academy.

A copy of the order of dismissal and materials, which were the basis for the expulsion, are sent to the law enforcement agency at the place of work of the employee after the expulsion of the student.

6. Organization of the educational process and research activities of the Academy

43. The Academy is independent in the implementation of the educational process within the limits established by the legislation of the Republic of Kazakhstan.

44. The Academy implements educational programs of postgraduate and additional education.

45. Study in the Academy is carried out in the state, Russian and English languages.

48. Specialists of state bodies and institutions, educational organizations and other non-state organizations, including international and foreign ones can be involved in the educational process on the basis of part-time or hourly wage payments along with the members of the faculty of the Academy.

49. Professional training, retraining and advanced training of law enforcement officers is carried out by the Academy in accordance with the legislation of the Republic of Kazakhstan, organizational and administrative acts of the Prosecutor General, the Rector of the Academy.

53. In order to defend the dissertations of doctoral students, the Dissertation Council functions at the Academy, which is created by order of the Rector of the Academy.

The competence, composition and organization of the activities of the Dissertation Council of the Academy are determined by the legislation of the Republic of Kazakhstan, organizational and administrative acts of the Rector of the Academy.

54. The procedure for organizing and conducting, as well as forms of monitoring, interim and final assessment of students is established by the Academy in accordance with the curriculum and the academic calendar and on the basis of normative legal acts regulating the procedure for organizing and conducting monitoring, interim and final assessment of students.

58. The Academy issues own sample educational documents, awards the degree of Doctor of Philosophy (PhD), Doctor of the profile in accordance with the Rules of awarding degrees, approved by order of the Minister of Education and Science of the Republic of Kazakhstan No.127 of March 31, 2011 (registered with the Ministry of Justice of the Republic of Kazakhstan No. 6951 May 13, 2011).

59. The research activity of the Academy is carried out in accordance with normative acts of the Republic of Kazakhstan and the orders of the Prosecutor General and the Rector of the Academy.

60. Employees and workers of law enforcement and other state agencies, postgraduates, doctoral candidates, as well as workers of other scientific, educational and other organizations, including foreign and international ones can participate in the research activity of the Academy. Creative (author) collectives can be created in the Academy to perform these works.

61. Scientific research conducted in the Academy is financed by the state budget, international organizations, funds received from contractual research, funds received from other sources of financial support provided by the legislation of the Republic of Kazakhstan and international treaties. Scientific research activity of the Academy can be carried out at the expense of grants in the manner established by the legislation of the Republic of Kazakhstan.

62. The Academy has the right to provide advice to state bodies and institutions and other organizations, to provide reviews, comments on draft of legal acts.

62-1. The Academy coordinates, monitors and evaluates research and education activities in the manner established by the legislation of the Republic of Kazakhstan, organizational and administrative acts of the Prosecutor General, and the Rector of the Academy.

7. International cooperation and cooperation of the Academy with state bodies, state and non-state organizations

63. The Academy carries out international cooperation in the field of scientific and educational activities with law enforcement agencies of foreign states, foreign educational and research institutions, international organizations and foreign legal entities in the manner established by the legislation of the Republic of Kazakhstan.

64. In the implementation of international cooperation, the Academy:

1) conducts negotiations and concludes agreements, treaties, memorandum in accordance with the legislation of the Republic of Kazakhstan;

2) attracts foreign scientists, experts and specialists to conduct scientific and educational activities;

3) collects and analyses information on major world trends in the development of science and education;

4) participates in scientific research, scientific and educational activities of law enforcement bodies of foreign states, foreign educational and research institutions, international organizations;

5) participates in programs of bilateral and multilateral exchange of students and scientific and pedagogical workers;

6) conducts international scientific and practical conferences, round tables, seminars, trainings and other scientific and educational events;

7) interacts with diplomatic and equivalent representatives of foreign states and international organizations and consular institutions on the territory of the Republic of Kazakhstan;

8) organizes the publication of scientific literature, textbooks and training manuals of international authors’ groups;

9) organizes and conducts training of foreign citizens in accordance with international treaties of the Republic of Kazakhstan and contracts.

65. International cooperation of the Academy can be carried out in other forms which do not contradict the legislation of the Republic of Kazakhstan and contribute to solving the statutory of the Academy.

66. The Academy has the right to interact with the structural subdivision of the Prosecutor General’s Office, regional prosecutors’ offices and state bodies, institutions, departments, educational institutions equated with them and other state and non-state organizations in the manner established by the legislation of the Republic of Kazakhstan.

67. The structural subdivisions of the Prosecutor General’s Office, the bodies, departments and institutions of the Prosecutor’s Office, other law enforcement agencies:
1) assist in the implementation of the scientific and educational activities of the Academy, including through the direct participation of their employees in scientific and educational activities;

2) provide analytical, informational and educational materials on ensuring the rule of law, order and the fight against crime, statistical data, draft of laws, other materials and documents at the request of the Academy and provide access to subordinate information resources.

8. Rights and duties of employees, officers, workers and students of the Academy

68. The rights and duties of employees, officers and workers of the Academy are determined by the legislation of the Republic of Kazakhstan, organizational and administrative acts of the Prosecutor General, official and functional duties.

69. Employees and officers of the Academy are entitled to:

1) familiarization with the regulatory legal acts regulating the activity of the Academy;

2) making proposals for improving the activity of the Academy;

3) representation of the Academy’s interest on issues related to the educational, research activities of the Academy in relation with state bodies, state and non-state organizations on the instruction and (or) coordination with the Rector of the Academy;

4) participation in scientific and educational events held in the Republic of Kazakhstan and foreign countries on the instruction and (or) coordination with the Rector of the Academy;

5) access to regardless of the form of ownership to state bodies, organizations within the limits of competence;

6) receiving information, documents and materials from the structural subdivision of the Prosecutor General’s Office, agencies, departments and institutions of the Prosecutor’s Office, other law enforcement agencies in accordance with the procedure established by the legislation of the Republic of Kazakhstan;

7) access in accordance with the established procedure to information constituting state secrets and other secrets protected by law in case if the performance of official and functional duties is related to the use of such information;

8) access to information which is in the information resources of subordinate state bodies and organizations in the manner established by the legislation of the Republic of Kazakhstan;

9) familiarization with the materials directly in the structural units of the Prosecutor General’s Office, agencies, departments and institutions of the Prosecutor’s Office, other law enforcement agencies within the competence;

10) participation, presence during inspections, forensic examinations, procedural actions, court sessions to perform tasks to improve the professional level of law enforcement officers, conduct research, ensure the connection of educational and scientific processes with practical activities;

11) if they fully perform official and functional duties of their position, with the consent of the Rector realization of paid teaching, scientific or other creative activity outside the Academy;

12) other rights defined by the legislation of the Republic of Kazakhstan.

70. Employees and officers of the Academy are obliged:

1) abide the Constitution, laws of the Republic of Kazakhstan ‘On countering corruption’, ‘On state secrets’, the Ethical Code of Civil Servants of the Republic of Kazakhstan (Rules of Service Ethics of Civil Servants), the Code of honour for employees of the system of prosecutors of the Republic of Kazakhstan and others set by the legislation of the Republic of Kazakhstan requirements for civil servants;

2) assume the restrictions established by the laws of the Republic of Kazakhstan;

3) comply with official and labour discipline;

4) exercise power within the limits of the rights granted to them and in accordance with their official and functional duties;

5) participate in public life and the implementation of the Academy’s image program;

6) take measures to ensure the safety of the assets of the Academy.

71. The rights and duties of educational, support and administrative personnel are determined by internal regulations and official duties.

72. Students have the right to:

1) receive education in accordance with the established state compulsory education standard;

2) participate in the decision of developing educational process, research, educational and cultural-enlightening work, improvement of progress, discipline and a life;

3) use educational auditoriums, educational-methodical rooms, reading rooms, libraries, sport facilities, inventory and other material and technical means of the Academy’s educational and material resources;

4) independently organize their work during the self-training hours;

5) participate in research work;

6) attend cultural events held by the Academy;

7) participate in sports sections, amateur art groups and other forms of creativity;

8) submit in accordance with the established procedure materials for publication, including for the editions of the Academy;

9) address questions, proposals, statements to the leadership of the Academy and receive a response on the merits of the appeal;

10) be encouraged for success in educational, scientific research and active participation in the socially useful activities of the Academy;

11) use other rights provided by the current legislation.

73. Students are required to:

1) strictly observe the current legislation of the Republic of Kazakhstan;

2) master theoretical knowledge, professional skills and abilities in the chosen speciality, timely and successfully implement the curriculum, all the prescribed study assignments, attend all types of training sessions, pass interim and final attestation;

3) attend training sessions, complete on time all types of tasks and activities provided by the curriculum and programs, as well as individual work plans of postgraduates and doctoral students;

4) comply with the requirements of this Charter, the internal regulations and other legal acts of the Academy in the part relating to them;
5) comply with official and labour discipline;

6) improve educational level and professional training;

7) strive to improve general culture, moral-volitional and physical perfection;

8) take care of the property of the Academy and take responsibility for the material damage caused to the Academy, in accordance with the legislation of the Republic of Kazakhstan;

9) keep and increase the best traditions of the Academy;

10) comply with safety regulation, labour protection, fire safety and sanitation requirements;

11) strictly keep state secrets.

74. Different forms of encouragement are established for academic success and active participation in research work.

76. The responsibility of employees, workers, trainees and students for material damage caused to the Academy is regulated by the legislation of the Republic of Kazakhstan.

9. Property and financial and economic activities of the Academy

77. The Academy has a separate property on the right of operational control.

78. The property of the Academy is formed at the expense of property transferred to it by the state, as well as other property, the value of which is reflected in the balance of the Academy.

79. The property assigned to the Academy belongs to the republican property.

80. The Academy is not allowed to independently alienate or otherwise dispose the property assigned to it, unless it stipulated by the laws of the Republic of Kazakhstan.

81. The Academy’s activities are financed from the national budget.
82. The Academy maintains its accounting records and reports in accordance with the legislation of the Republic of Kazakhstan.

83. The Academy for the implementation of the statutory activities may involve additional sources of financial and logistical support in accordance with the legislation of Republic of Kazakhstan.

84. The audit and audit of the financial and economic activities of the Academy is carried out by the Prosecutor General’s Office and other authorized bodies.

10. Amendments and additions to this Charter

85. Amendments and additions to this Charter are made by an order of the Prosecutor General.

86. Amendments and additions to the Charter are registered in accordance with the legislation of the Republic of Kazakhstan.

11. Reorganization and liquidation of the Academy

87. The reorganization and liquidation of the Academy is carried out in accordance with the legislation of the Republic of Kazakhstan.
