REGULATION
on the Institute of Postgraduate Education of the Law Enforcement Academy under the Prosecutor General’s Office of the Republic of Kazakhstan

1. General regulations

1. The Institute of postgraduate education of the Law Enforcement Academy under the Prosecutor General’s Office of the Republic of Kazakhstan (hereinafter – the Institute) is an independent structural division of the Law Enforcement Academy under the Prosecutor General’s Office of the Republic of Kazakhstan (hereinafter – the Academy).

2. The Institute is guided by the Constitution of the Republic of Kazakhstan, laws of the Republic of Kazakhstan “On Law Enforcement service”, “On the Prosecutor’s Office”, “On Education”, “On Science”, other legal acts of the Republic of Kazakhstan concerning the activities of the Institute, organizational and administrative acts of the Prosecutor General of the Republic of Kazakhstan (hereinafter – the Prosecutor General), his deputies, Rector of the Academy, as well as this Regulation.

3. The structure and staff number of the Institute are determined by the Rector in the manner established by the legislation of the Republic of Kazakhstan.

4. The Institute consists of:

1) Department of educational and methodical work;

2) Department of social and humanitarian disciplines;

3) Department of general legal disciplines;

4) Department of special legal disciplines.

2. Main tasks, functions, rights and duties of the Institute

5. Task:
ensuring the implementation of educational programs of postgraduate education.

Functions:
1) the organization and conduct of the educational process, including the use of distance learning technologies in the manner established by the legislation of the Republic of Kazakhstan and the legal acts of the Rector of the Academy;

2) organization and conduct of educational and methodical work on educational programs of postgraduate education, research work on one or more similar disciplines of the departments of the Institute in the manner prescribed by the legislation of the Republic of Kazakhstan and the legal acts of the Prosecutor General and the Rector of the Academy;

3) the organization and conduct of progress monitoring, intermediate and final certification of students in the manner prescribed by the legislation of the Republic of Kazakhstan, and legal acts of the Prosecutor General and the Rector of the Academy;

4) organizing professional practice and internships for Academy students in the manner established by the legislation of the Republic of Kazakhstan, legal acts of the Prosecutor General and the Rector of the Academy;

5) supporting the activities of the Educational and Methodological Council of the Academy and the Republican Educational and Methodological Association in the specialty “Law Enforcement”;

6) supporting the activities of the Dissertation Council of the Academy;

7) cooperation and interaction with educational institutions within the framework of agreements and memorandums concluded by the Academy;

8) carrying out an analysis of the educational activities of the Institute, including in terms of their practice orientation;

9) search, study, make proposals and implement in the practical activities of the Institute a positive foreign, national experience, innovative forms and methods for the implementation of educational programs of postgraduate education;

10) development, approval and updating of legal acts relating to the organization of the Institute’s activities, including on the improvement of the educational process;

11) organizing events and taking measures to improve the qualifications of the Institute’s faculty;

12) in accordance with the requirements of legal acts, the organization of admission to the Academy for educational programs of postgraduate education, including the provision of campaign work;

13) maintaining the register of scientific articles of Academy students;

14) making proposals for improving the activities of the Institute;

15) implementation of other functions stipulated by the regulatory legal acts of the Republic of Kazakhstan, legal acts of the Prosecutor General and the Rector of the Academy.

6. Task:

organization of work with master and doctoral students of the Academy.

Functions:

1) implementation and organization of the fulfillment of the requirements established by the Internal Regulations of the Academy students;

2) organization of work on the admission, transfer, restoration and expulsion of master and doctoral students of the Academy;

3) organization of educational work among students in the manner established by the legislation of the Republic of Kazakhstan and the legal acts of the Prosecutor General and the Rector of the Academy;

4) ensuring the organization and monitoring of students’ compliance with the requirements established by the Internal Regulations of the Academy students;

5) support of the activities of the Council of master and doctoral students of the Academy;

6) the development of legal acts relating to the implementation of the requirements of the Internal Regulations of the Academy students, approved by the Rector of the Academy;

7) making proposals for improving the organization of work with master and doctoral students of the Academy;

8) implementation of other functions provided by the regulatory legal acts of the Republic of Kazakhstan, legal acts of the Prosecutor General and the Rector of the Academy.

9. Rights and duties of the Institute:

1) In accordance with the legislation of the Republic of Kazakhstan and the organizational and administrative acts of the Prosecutor General and the Rector of the Academy, the staff of the Institute have the right to:

participate in meetings with the leadership of the Prosecutor General’s Office, the Rector of the Academy, heads of the Academy’s structural divisions, as well as those organized and held in state bodies and non-governmental organizations on issues relating to the activities of the Institute;

in accordance with the established procedure, request and receive information, documents and materials necessary for carrying out tasks and performing the functions assigned to the Institute from structural subdivisions of the Academy;

in accordance with the established procedure, request and receive information, documents and materials necessary for carrying out tasks and performing the functions assigned to the Institute from state bodies, organizations and institutions;

interact with state bodies, institutions and organizations, public and international organizations on issues within the competence of the Institute;

make suggestions on improving the legislation of the Republic of Kazakhstan, organizing the work of the Academy and other bodies and institutions of the Prosecutor’s Office;

for professional retraining, advanced training and internship in the manner established by the legislation of the Republic of Kazakhstan;

exercise other powers provided by the legislation of the Republic of Kazakhstan, legal acts of the Prosecutor General, Rector of the Academy.

2) In accordance with the legislation of the Republic of Kazakhstan and the organizational and administrative acts of the Prosecutor General and the Rector of the Academy, the staff of the Institute have to:

carry out activity within the limits of the granted powers;

strictly observe the requirements of the legislation of the Republic of Kazakhstan, legal acts of the Prosecutor General and the Rector of the Academy in the performance of tasks and functions assigned to the Institute;

take measures to eliminate and prevent future violations of the law within the competence;

get acquainted with the legal acts of the Prosecutor General, the Rector of the Academy, regulating the activities of the Academy and its structural subdivisions, other legal acts of the Republic of Kazakhstan relating to the tasks and functions of the Institute;

develop drafts of legal acts and organizational and administrative documents in accordance with the tasks and functions of the Institute;

consider appeals of individuals and legal entities in accordance with the procedure and deadlines established by the legislation;

keep state secrets and other secrets protected by law;

exercise other powers provided by regulatory legal acts of the Republic of Kazakhstan, legal acts of the Prosecutor General and the Rector of the Academy.

3. Organization of the Institute’s activity

10. The Institute has the powers necessary to realize its main tasks and functions, in accordance with legislative acts, acts of the President of the Republic of Kazakhstan, other regulatory legal acts of the Republic of Kazakhstan, orders, instructions of the Prosecutor General and the Rector of the Academy.

11. The Institute is headed by a director who is appointed and dismissed by the Rector of the Academy in the manner established by the legislation of the Republic of Kazakhstan.

12. The Director of the Institute has a deputy who is at the same time the head of the Department of educational and methodological work.

13. The Director of the Institute exercises overall management of the Institute’s activities and is personally responsible for the fulfillment of the tasks assigned to the Institute and the exercise of its functions.

14. The Director of the Institute submits to the Rector of the Academy the proposals on the structure and staffing of the Institute agreed with the supervising Vice-rector of the Academy.

15. Therefore, the Director of the Institute:

1) determines the powers of his deputies in coordination with the supervising Vice-rector of the Academy;

2) determines the powers of the heads of structural subdivisions of the Institute in coordination with the supervising Vice-rector of the Academy;
3) organizes and coordinates the work of the Institute, ensures the interaction of the Institute with the structural subdivisions of the Prosecutor General’s Office, its departments and institutions, the Academy, regional prosecutor’s offices and the central state bodies equated to them;

4) organizes and ensures control over the execution of orders, instructions of the Prosecutor General, the Rector of the Academy, the Vice-rector of the Academy, decisions of the collegial bodies of the Prosecutor General’s Office, the Academy, administrative and operational meetings under the Prosecutor General and the Rector on matters within the competence of the Institute;

5) conducts operational meetings on the work of the Institute, distributes the received materials and appeals to the staff of the Institute, instructs them in accordance with their functional responsibilities;

6) organizes the preparation of materials for the attestation of the Institute’s staff;

7) selects and places personnel at the Institute, provides subordinate officers and employees with proper working conditions in coordination with the supervising Vice-rector of the Academy;

8) submits proposals to the Rector for encouraging or applying disciplinary measures to the staff of the Institute in consultation with the supervising Vice-rector of the Academy;

9) ensures the observance of performing, official and labour disciplines by employees of the Institute;

10) ensures and supervises the execution of orders, instructions of the Prosecutor General, Rector of the Academy, Vice-rector of the Academy, decisions of collegial bodies of the General Prosecutor’s Office, Academy, admitstrative and operational meetings under the Prosecutor General and Rector by employees and officers on issues related to the competence of the Institute;

11) conducts admission of students of the Academy;

12) performs other duties and personal assignments on the instructions of the Rector, supervising Vice-rector of the Academy;

13) signs documentation on behalf of the Institute;

14) exercise other powers in accordance with laws, acts of the President of the Republic of Kazakhstan, orders of the Prosecutor General and the Rector of the Academy.

16. Deputy director – head of the Department of educational and methodological work of the Institute:

1) coordinates the activities of the Institute, its structural subdivisions within his powers;

2) exercises general management of the Institute’s activities and bears personal responsibility for carrying out the tasks assigned to him and exercising his functions during the period of absence of the Director of the Institute;

3) makes proposals to the Director of the Institute on recruitment, distribution of duties between employees and officers, on assigning a class rank, encouraging, and bringing to disciplinary responsibility;

4) provides preparation of materials for attestation of the Institute staff;

5) carries out management and control over the activities of the headed subdivision, compliance of the performing, official and labor disciplines by the employees;

6) conducts admission of students of the Academy;

7) conducts operational meetings on supervised issues, distributes received materials and appeals among the Institute staff, instructs them in accordance with their functional responsibilities;

8) organizes the work of the headed subdivision and plans its work, bears personal responsibility for the implementation of the tasks assigned to it;

9) defines the rights and obligations of employees and officers of the headed subdivision;

10) ensures control over the proper performance of service (functional) duties by staff of the entrusted subdivision;

11) provides advanced training for subordinate employees and officers;

12) participates in the work of the collegial bodies of the Academy;

13) organizes the clerical work of the Institute;

14) signs documentation within the competence of the Institute, including on behalf of the Director of the Institute;

15) performs other functions assigned to him by the supervising Vice-Rector of the Academy and the Director of the Institute.

17. Employees and officers of the Institute carry out the functions assigned to them in accordance with the substantive principle of the distribution of duties, as well as other instructions of the management of the Academy’s Institute.

18. Documents sent on behalf of the Institute to other structural subdivisions of the Academy on issues within the competence of the Institute are signed by the Director of the Institute and in the absence of the Director of the Institute, by his substitute.

19. The Institute reports directly to the supervising Vice-rector of the Academy organizationally and functionally independent from other structural subdivisions and officials of the Academy.

20. Clerical work at the Institute is carried out in accordance with the Rules for Documentation and Document Management in the bodies, departments and institutions of the Prosecutor’s Office and organizational and administrative acts on securing the secrecy regime.
