REGULATION
on the Institute of Professional Development of the Law Enforcement Academy under the Prosecutor General’s Office of the Republic of Kazakhstan

1. General regulations

1. The Institute of Professional Development of the Law Enforcement Academy under the Prosecutor General’s Office of the Republic of Kazakhstan (hereinafter – the Institute) is an independent structural division of the Law Enforcement Academy under the Prosecutor General’s Office of the Republic of Kazakhstan (hereinafter – the Academy).

2. The Institute is guided by the Constitution of the Republic of Kazakhstan, laws of the Republic of Kazakhstan “On Law Enforcement service”, “On the Prosecutor’s Office”, “On Education”, “On Science”, other legal acts of the Republic of Kazakhstan concerning the activities of the Institute, organizational and administrative acts of the Prosecutor General of the Republic of Kazakhstan (hereinafter – the Prosecutor General), his deputies, Rector of the Academy, as well as this Regulation.

3. The structure and staff number of the Institute are determined by the Rector in the manner established by the legislation of the Republic of Kazakhstan.

4. The Institute consists of:

1) Department of the Organization of Professional Development, including the Academy representatives in the regions;

2) Department of International Education in the Field of Countering Global Threats;

3) Departments of Prosecution and Language development;

4) Department of Investigative and Operational Work.

2. Main tasks, functions, rights and duties of the Institute

5. Task:

provision of training for applicants who have joined the law enforcement agencies of the Republic of Kazakhstan for the first time.

Functions:
1) study and determine the need for training of young professionals and candidates for service in cooperation with law enforcement agencies of the Republic of Kazakhstan;

2) formation of schedules, internship of officers, curricula and programs of professional training courses in the manner established by the legislation of the Republic of Kazakhstan, and legal acts of the Rector of the Academy;

3) selection of teaching staff;

4) creation of conditions for students to live (for the period of training) in the manner established by the legislation of the Republic of Kazakhstan and legal acts of the Rector of the Academy;

5) the organization and conduct of the educational process in accordance with the procedure established by the legislation of the Republic of Kazakhstan and the legal acts of the Rector of the Academy;

6) organization and conduct of educational and methodological work in accordance with the procedure established by the legislation of the Republic of Kazakhstan, and legal acts of the Rector of the Academy;

7) monitoring the knowledge of students in the manner established by the legislation of the Republic of Kazakhstan, and legal acts of the Rector of the Academy;

8) analysis of the effectiveness of training courses for applicants of law enforcement agencies who applied for the first time;

9) search, study and implementation of positive foreign, national experience, innovative forms and methods of professional training of persons entering the service of law enforcement agencies of the Republic of Kazakhstan for the first time;

10) make proposals on improving the activities of the Department, the Institute;

11) develop and update draft regulatory acts;

12) implementation of other functions stipulated by the regulatory legal acts of the Republic of Kazakhstan, legal acts of the Prosecutor General and the Rector of the Academy, relating to this task.

6. Task:
provision of advanced training and professional retraining of law enforcement officers.

Functions:
1) the study and determination of the quantitative and qualitative requirements for the advanced training and professional retraining of law enforcement officers in cooperation with law enforcement agencies of the Republic of Kazakhstan;

2) the formation of schedules, curricula and programs for advanced training courses and professional retraining of law enforcement officers in the manner established by the legislation of the Republic of Kazakhstan and the legal acts of the Rector of the Academy;

3) selection of teaching staff;

4) creation of conditions for students to live (for the period of training) in the order established by the legislation of the Republic of Kazakhstan and legal acts of the Rector of the Academy;

5) the organization and conduct of the educational process in accordance with the procedure established by the legislation of the Republic of Kazakhstan and the legal acts of the Rector of the Academy;

6) organization and conduct of educational and methodological work in accordance with the procedure established by the legislation of the Republic of Kazakhstan and legal acts of the Rector of the Academy;

7) monitoring the knowledge of students in the manner established by the legislation of the Republic of Kazakhstan and legal acts of the Rector of the Academy;

8) conducting analysis of the effectiveness of advanced training courses for professional development and professional retraining of law enforcement officers;

9) search, study and implementation of the positive foreign, national experience, innovative forms and methods of professional development and professional retraining of law enforcement officers in the practical activities of the Institute;

10) cooperation and interaction with educational institutions within the framework of agreements, memorandums concluded by the Academy;

11) make proposals on improving the activities of the Department, the Institute;

12) develop and update draft regulatory acts;

13) implementation of other functions stipulated by the regulatory legal acts of the Republic of Kazakhstan, legal acts of the Prosecutor General and the Rector of the Academy, relating to this task.

7. Task:

provision of advanced training and professional retraining for law enforcement officers with Academy Representations in the regions.

Functions:

1) coordination and organization of work to improve the professional level of law enforcement officers in the relevant region, including:

2) organization and conduct of educational, educational and methodical work (scheduling, preparation and sending of a request to the prosecution authorities, Economic Investigation Service, National Anti-Corruption Bureau about providing lists of employees, preparing handouts, control and monitoring the educational process, forming test tasks for carrying out entrance and output controls, questioning the students before and after the courses;

3) assisting the Academy in conducting on-site retraining and advanced training courses for law enforcement officers;

4) assisting law enforcement agencies of the relevant region in organizing and conducting training activities (in coordination with the leadership of the Academy);

5) interaction with personnel and structural divisions of law enforcement agencies on the issues of professional development of employees;

6) monitoring the professional growth of graduates (postgraduates, doctoral students) of the Academy (application of skills and abilities in practical work, tracking personal and career growth, etc.);

7) the implementation on an ongoing basis of the collection and study of empirical material of law enforcement activities (practical data, analytical materials, newsletters) for research work and sending to the Academy at the request of the relevant structural unit;

8) participation in the organization of scientific conferences and other events held in the relevant region in the framework of the Academy’s research activities;

9) the establishment and strengthening of cooperation with universities in the region on ongoing fundamental and applied research in the law enforcement field;

10) making proposals on the improvement of scientific and educational work, the introduction of effective forms and methods of teaching, based on the study of domestic and foreign experience;

11) organization of work to identify and disseminate the positive experience of the activities of the prosecution authorities;

12) implementation on an ongoing basis of the collection and study of information and analytical materials of law enforcement activities for the implementation of the tasks of the Academy;

13) assist in the development of methodological literature by law enforcement agencies (methodological manuals, recommendations, etc.);

14) implementation of vocational guidance and explanatory work on issues of admission to study at the Academy for postgraduate education programs;

15) presentation to encourage employees who took the initiative and took an active part in raising the professional level in the region;

16) a summary of the work done by semester, with the sending of analytical information to the Academy no later than the first decade of the month following the reporting period;

17) attraction to cooperation of the most experienced employees, veterans of law enforcement agencies, employees of the judicial system, state bodies and institutions, teachers of higher educational institutions (by agreement);

18) performing other work arising from the tasks of scientific and educational activities on behalf of the Rector, supervising Vice-Rector, the head of the relevant structural division of the Academy.

8. Task:

Organization and conducting international scientific and educational activities of the Department of International Education in the field of countering global threats.

Functions:

1) search, study and introduction into Academy’s practice positive national and foreign experience, innovative forms and methods of training law enforcement officers;

2) development of educational and special educational programs;

3) making proposals for the formation of schedules, curricula and curricula for advanced training courses for law enforcement officers;

4) interaction with partners on the issues of training events (seminars, conferences, round tables, trainings, etc.);

5) participation in conferences, seminars, working groups and other events on issues of international training in the field of countering global threats;

6) studying and determining the need for advanced training of law enforcement officers in the area of countering global threats in cooperation with law enforcement agencies of the Republic of Kazakhstan and other organizations;

7) the formation of a pool of lecturers in the field of countering global threats;

8) analysis of the effectiveness of training courses in the activities of the Department;

9) making proposals on the improvement of the activities of the Department, the Institute, the Academy;

10) development and updating of draft legal acts on the activities of the Department;

11) the implementation of other functions provided by the legislation that do not contradict the main task in the framework of the Department.

9. Task:

Organization of work on the implementation of state programs in the field of functioning and development of state and other languages.

Functions:

1) the study of foreign best practices, ways and methods of language teaching;

2) the organization of work to expand the sphere of use of the state language in the Academy;

3) the organization of the state language training of employees and officers of the Academy;

4) the development and training of foreign languages;

5) implementation of programs for the transition of the Kazakh alphabet to the Latin script.

10. Rights and obligations of Institute staff:

1) In accordance with the legislation of the Republic of Kazakhstan and the organizational and administrative acts of the Prosecutor General and the Rector of the Academy, the staff of the Institute have the right to:

participate in meetings with the leadership of the Prosecutor General’s Office, the Rector of the Academy, heads of the Academy’s structural units, as well as those organized and held in state bodies and non-governmental organizations on issues related to the Academy’s activities;

request and receive, in the established manner, information and materials from the structural divisions of the Academy, necessary for the fulfillment of the tasks and functions assigned to the Institute;

request and receive, in accordance with the procedure established by the legislation, information and materials from government bodies, organizations and institutions on matters relating to the the Academy’s activities;

make proposals for improving the legislation of the Republic of Kazakhstan, organizing the work of the Academy and other prosecution bodies and institutions;

for professional retraining, advanced training and internship of employees in the manner established by the legislation of the Republic of Kazakhstan;

participate in scientific and practical and international conferences, seminars and round tables;

publish scientific articles in the established manner;

carry out cooperation with the departments, the Interdepartmental Research Institute of the Academy for scientific research ;

exercise other powers provided by law.

2) In accordance with the legislation of the Republic of Kazakhstan and the organizational and administrative acts of the Prosecutor General and the Rector of the Academy, the staff of the Institute must:

carry out activities within the powers granted;

strictly comply with the requirements of legislation, acts of the Prosecutor General and the Rector of the Academy in the performance of the tasks and functions assigned to the Institute;

get acquainted with the legal acts of the Prosecutor General, the Rector of the Academy, regulating the activities of the Academy and its structural divisions, other legal acts of the Republic of Kazakhstan concerning the tasks and functions of the Department;

develop projects of organizational and administrative documents in accordance with the tasks and functions of the Department;

take measures to eliminate and prevent future violations of the law within the competence;

consider appeals from individuals and legal entities in the manner and within the terms established by the legislation;

keep state secrets and other secrets protected by law;

exercise other powers provided by regulatory legal acts of the Republic of Kazakhstan, legal acts of the Prosecutor General and the Rector of the Academy.

3. Organization of the Institute’s activity

11. The Institute has the powers necessary to realize its main tasks and functions, in accordance with legislative acts, acts of the President of the Republic of Kazakhstan, other regulatory legal acts of the Republic of Kazakhstan, orders, instructions of the Prosecutor General and the Rector of the Academy.

12. The Institute is headed by a director who is appointed and dismissed by the Rector of the Academy in the manner established by the legislation of the Republic of Kazakhstan.

13. The Director of the Institute has a deputy.

14. The Director of the Institute exercises overall management of the Institute’s activities and is personally responsible for the fulfillment of the tasks assigned to the Institute and the exercise of its functions.

15. The Director of the Institute submits to the Rector of the Academy the proposals on the structure and staffing of the Institute agreed with the supervising Vice-Rector of the Academy.

16. Therefore, the Director of the Institute:

1) determines the powers of his deputy and heads of structural subdivisions of the Institute in coordination with the supervising Vice-Rector of the Academy;

2) organizes and coordinates the work of the Institute, ensures the interaction of the Institute with the structural divisions of the Prosecutor General’s Office, its departments and institutions, the Academy, regional prosecutor’s offices and the central state bodies equated to them;

3) organizes and ensures control over the execution of orders, instructions, instructions of the Prosecutor General, the Rector of the Academy, the Vice-Rector of the Academy, decisions of the collegial bodies of the Prosecutor General’s Office, the Academy, operational meetings under the Prosecutor General and the Rector on issues within the competence of the Institute;

4) conducts operational meetings on the work of the Institute, distributes the received materials and appeals to the staff of the Institute, instructs them in accordance with their functional responsibilities;

5) organizes the preparation of materials for the attestation of the staff of the Institute;

6) selects and places personnel at the Institute, provides subordinate officers and employees with proper working conditions in coordination with the supervising Vice-Rector of the Academy;

7) submits proposals to the Rector for encouraging or applying disciplinary measures to the staff of the Institute in coordination with the supervising Vice-Rector of the Academy;

8) ensures the observance of performing, official and labour disciplines by employees of the Institute;

9) organizes consideration of applications from students and their leadership at the place of service;

10) performs other duties and their personal instructions on behalf of the Rector, supervising Vice-Rector of the Academy;

11) exercise other powers in accordance with the laws, acts of the President of the Republic of Kazakhstan, orders of the Prosecutor General and the Rector of the Academy.

17. Deputy director of the Institute:

1) coordinates the activities of the Institute, its structural divisions within his (their) powers;

2) exercises general management of the Institute’s activities and bears personal responsibility for carrying out the tasks assigned to him and exercising his functions during the period of absence of the Director of the Institute;
3) submits to the Director of the Institute proposals for recruitment, distribution of duties between employees, assignment of class rank, promotion, disciplinary responsibility;

4) provides preparation of materials for attestation of the Institute staff;

5) conducts operational meetings on issues of the supervised area, distributes received materials and appeals among Institute staff, gives them instructions in accordance with their functional duties;

6) provides and supervises the execution by employees of orders, directives, instructions of the Prosecutor General, the Rector of the Academy, the Vice-Rector of the Academy, decisions of collegial bodies of the Prosecutor General’s Office, the Academy, operational meetings under the Prosecutor General and the Rector on matters within the competence of the Institute;

7) organizes the clerical work of the Institute;

8) endorse official documentation within its competence;

9) signs the official documentation within the competence of the Institute;

10) performs other functions assigned by the Director of the Institute.

18. The staff of the Institute performs the functional duties assigned to them in accordance with the substantive principle of the distribution of duties, as well as other assignments of the management of the Institute of the Academy.

19. Documents sent on behalf of the Institute to other structural units of the Academy are signed by the supervising Vice-Rector, the Director of the Institute, and in the absence of the Director of the Institute, by his substitute.

20. The Institute reports directly to the Rector of the Academy, supervising Vice-Rector of the Academy, organizationally and functionally independent from other structural divisions and officials of the Academy.

21. Clerical work at the Institute is carried out in accordance with the Rules for Documentation and Document Management in the bodies, departments and institutions of the Prosecutor’s Office and organizational and administrative acts on securing the secrecy regime.
