About important aspects of privacy protection

The Interdepartmental Research Institute of the Law Enforcement Academy has prepared a monograph “Privacy”.

According to the authors, the right to privacy is one of the fundamental rights guaranteed by the Constitution. At the same time, its implementation causes various disputes, and in law enforcement practice there are many difficulties with the interpretation of the content of this right. This is primarily due to the multidimensional nature of the term “private life”.

Kazakhstan’s legal science does not yet have a generally accepted and unified definition of this concept. The need to fill this gap, including by providing a legislative definition, has been repeatedly pointed out in the annual messages of the Constitutional Council.

As part of the research, a lot of painstaking work was carried out. More than 120 Kazakhstan and international legal acts were studied and their complex analysis was made. The article analyzes the law enforcement practice in civil, administrative and criminal cases of this category over the past seven years.

All this allowed scientists to formulate an optimal definition of the legal concept of “privacy”, which is based on scientific methods, takes into account the norms of national legislation, meets generally recognized international standards and can be applied in law enforcement.
