Mass riots: the criminal-legal aspect of proof

The Interdepartmental Research Institute of the Academy, commissioned by the Prosecutor General’s Office, has launched a scientific study on the topic “Mass riots: the criminal-legal aspect of proof”.

There is no definition of mass riots in the current norms of national law. At the same time, their occurrence is one of the grounds for restricting human and civil rights and freedoms.

The disposition of the corresponding article of the Criminal Code does not allow to outline clear boundaries and competes with a variety of related compositions. This creates problems in practice.

The authors’ team will have to figure out what the concept of “mass riots” includes.

As a result, it is planned to develop scientifically based criteria for distinguishing such crimes from other criminal offenses that infringe on public safety and public order.

This will allow the criminal prosecution authorities to correctly apply the norms of the current legislation and minimize the unjustified involvement of citizens in the orbit of the criminal process.
