Privacy problems

A round table on privacy issues within the framework of the Criminological Forum is held in the General Prosecutor’s Office.

The event was organized by the General Prosecutor’s Office and the Academy of Law Enforcement Agencies with the support of the European Union project “Improving Criminal Justice in Kazakhstan”.

The forum is devoted to the problems of ensuring the constitutional rights of citizens to privacy.

The event was attended by representatives of the deputy corps, law enforcement and special bodies, a number of ministries and departments, leading domestic law scholars, international experts.

As noted by the participants, the right to privacy is one of the fundamental rights guaranteed by the Constitution and international agreements. It should protect the person from any encroachments on private life.

Domestic legislation established legal means for protecting private life, forms and procedures for bringing to responsibility for their violation. At the same time, in law enforcement practice there are many difficulties with the interpretation of the content of this right.

During the discussions, topical problems of interference in the private life of citizens in the course of operational and search activities, illegal collection and disclosure of information relating to personal and family secrets were raised. In this connection, various opinions were given on the issues of the boundaries of the expression of one’s own opinion about the private life of public figures.

As a result of the meeting, recommendations were developed aimed at improving the current legislation in the sphere of private life protection, based on international standards and a progressive understanding of this fundamental right.
