On the protection of the rights of entrepreneurs and the fight against raiding

Vice-Rector-Director of the Interdepartmental Research Institute of the Academy of Law Enforcement Agencies Gulnar Shushikova took part in a meeting of the Council for the Protection of the Rights of Entrepreneurs and Anti-Corruption of the National Chamber of Entrepreneurs “Atameken”.

Speaking from the rostrum of the forum, G.Shushikova spoke about the work of the Academy to implement the instructions of the Head of State in the field of business support and protection of entrepreneurs from unlawful interference in their activities. The results of this work are reflected at the legislative and practical level.

Thus, according to the order of NCE “Atameken”, a scientific analysis was conducted on topical issues of entrepreneurship development. Based on the results of the study, proposals were initiated to strengthen the protection of business, amendments to the legislation providing for criminal liability for restricting the rights and legitimate interests of entrepreneurs were prepared.

In particular, it is proposed to tighten responsibility for violations of the procedure for conducting inspections, unlawful refusal to issue a special permit (license), illegal suspension of activities and (or) operations on a bank account, illegal involvement in charity, as well as unlawful refusal or application of benefits and preferences. These amendments were fully supported and introduced into the Criminal Code.

The speaker also focused on the results of the work to protect the rights of entrepreneurs from raiding.

It is noted that the Methodological recommendations prepared by the Academy on the consideration of citizens’ appeals, conducting a pre-trial investigation on the facts of raiding are actively used in the work of law enforcement agencies and NCE “Atameken”.

Currently, an updated edition of the recommendations is being developed, taking into account the Administrative Procedural Code put into effect and the adopted amendments to the Criminal Code.
